1. Who we are
Tack is a construction management service operated by [Legal entity name], a Texas [LLC] (“Tack,” “we,” “us”). These terms govern your use of usetack.co, app.usetack.co and any related services (the “Service”). By creating an account or using the Service, you agree to these terms on behalf of yourself and the company you represent.
2. Accounts
You must be at least 18 and able to enter a binding contract. The person who creates a company account is its owner and is responsible for the users they invite, the roles they assign and all activity under the account. Keep your login credentials secure and tell us promptly at [support email] if you believe your account has been accessed without permission.
3. Subscription and billing
The Service is billed at a flat monthly price per company, currently $10 per month, with unlimited users and jobs. Fees are charged in advance each month and are non-refundable except where required by law. We may change pricing with at least 30 days’ notice; changes take effect at your next billing period. You can cancel at any time, and your access continues until the end of the paid period. Usage of AI features may be subject to reasonable monthly limits, shown in your account settings.
4. Your content
You own the schedules, budgets, documents, photos, logs and other information you put into Tack (“Your Content”). You grant us a limited license to host, process and display Your Content only as needed to provide and improve the Service and as described in our Privacy policy. You are responsible for having the rights to upload Your Content, including photos of people and property and documents from clients, subcontractors and suppliers.
5. AI features
Tack includes AI features that read your job data to answer questions, suggest changes, flag possible issues, read quotes and invoices, and tag photos. AI output can be wrong or incomplete. Changes suggested by AI are applied only after a user confirms them, and you are responsible for reviewing them. Watchdog flags are a project management aid, not a guarantee that every issue will be caught.
6. Not professional advice
Tack is a tool for organizing and tracking construction work. It does not provide engineering, architectural, legal, accounting, safety or code-compliance advice, and it does not inspect, verify or approve any work. Schedule dates, cost projections and flags are estimates based on the information you enter. You remain solely responsible for your projects, contracts, permits, inspections, jobsite safety and decisions.
7. Acceptable use
Don’t use Tack to break the law, infringe others’ rights, upload malware, attempt to access other companies’ data, probe or overload the Service, resell it without permission, or send text messages to people who have not agreed to receive them. We may suspend accounts that violate these terms.
8. Text messages to subcontractors
If you use Tack to send schedule texts to subcontractors, you confirm that each recipient has agreed to receive them. Recipients can reply STOP to opt out at any time. Message and data rates may apply.
9. Availability and changes
We work to keep Tack available and your data backed up, but the Service is provided “as is” and “as available,” without warranties of any kind to the extent permitted by law. We may update features over time and will give notice of changes that materially reduce functionality.
10. Limitation of liability
To the extent permitted by law, Tack will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, delays, construction defects, cost overruns or lost data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
11. Ending your account
You can cancel and request deletion of your company’s data at any time. You may export your data before cancelling. After cancellation, we delete Your Content within [30] days, except where we must keep certain records by law. We may terminate accounts for serious or repeated violations of these terms.
12. General
These terms are governed by the laws of the State of Texas. Disputes will be resolved in the state or federal courts located in [County], Texas.
